Should student evaluations remain confidential in the midst of a discrimination lawsuit?

A former assistant professor is suing Pomona College for discrimination, after being denied tenure.  Her lawyer wants to see her student evaluations as well as those of colleagues who did receive tenure.  The court must decide if student expectations of privacy trump the plaintiff's right to make her case.
